1. Welcome to Elsewhere

These Terms of Service (“Terms”) are a contract between you and SnowPea Studios LLC, an Indiana limited liability company (“SnowPea,” “we,” “us”). They cover the Elsewhere mobile app, elsewheredating.com, and our related services (together, “Elsewhere”).

By creating an account or using Elsewhere, you agree to these Terms and our Privacy Policy. If you don't agree, don't use Elsewhere.

2. Who can use Elsewhere

You must be at least 18 years old to use Elsewhere.

By using Elsewhere, you confirm that:

• you are at least 18 years old and, unless adulthood starts later than 18 where you live, can form a binding contract there;
• you are allowed to use Elsewhere under the laws that apply to you;
• you have never been convicted of a violent or sexual crime, and you are not required to register as a sex offender anywhere;
• we have not previously banned you from Elsewhere; and
• you are not located in a country under a US government embargo, and you are not on any US government list of prohibited or restricted parties.

Age checks. We check age using the birthday you enter and age information from Apple or Google where available. If we learn that someone under the minimum age has an account, we will remove it.

Where Elsewhere is available. Elsewhere is offered only in countries where it is available on the Apple App Store or Google Play. It is not offered in the United Kingdom. Don't use Elsewhere from a country where it isn't offered, and don't misrepresent your country to get around these limits.

3. Your account

You can sign up with a phone number, a Google account, or an Apple account. Each person may have only one account.

• Be accurate. Your age, photos, country, and other profile details must be true, and your photos must be of you.
• Keep it secure. You're responsible for activity on your account. If you think someone else has accessed it, email us right away at hello@elsewheredating.com.
• Keep it personal. Don't sell, transfer, or share your account, or let anyone else use it.

If you sign in with Google or Apple, their terms also apply to that sign-in. We may ask you to confirm your phone number, complete photo verification, or give other information before you can use some features.

4. How Elsewhere works

Elsewhere is for long-distance and international dating. You choose the countries you want to see, and your feed is built mainly from those countries and the preferences you set. Your profile is shown to people who choose your country, wherever they live.

Automatic translation. Profiles, prompts, photo comments, and messages are translated automatically into each person's language by an artificial intelligence (AI) model. Translations can be wrong, lose tone or context, or change meaning. You're responsible for what you write in your own words, and you should double-check anything important, such as plans, money, or health, with the other person.

Features vary. Features, profile options, and prices may differ by country, device, and app version. Some profile options, such as gender identity, sexual orientation, or religion, are not offered in some countries. We may add, change, or remove features at any time, and early or test features may not work as expected.

5. Photo verification

Photo verification helps show that you're a real person who matches your profile photos. We may ask you to complete it, and some features may require it.

How it works. You take a live selfie in the app. Our systems check that it's a live person and compare it with your profile photos. To do this, we create face scans from your selfie and your profile photos. These scans are biometric information. We ask for your consent in the app before we collect them, and we delete the selfie and all face scans as soon as the check is finished. Our Privacy Policy explains this in more detail.

What a badge means. If you pass, your profile may show that it's verified. A verified badge only means that your selfie matched your profile photos when you took it. It does not confirm anyone's name, age, identity, background, or intentions.

We may ask you to verify again, for example if you change your photos or we see signs of fraud. If you fail or skip verification, we may limit your account.

6. Your content

You own what you post and send on Elsewhere, including photos, profile text, comments, and messages (“your content”). You're responsible for it.

Your license to us. You give us a worldwide, non-exclusive, royalty-free license to host, store, copy, display, translate, reformat, and distribute your content, and to make translated and resized versions of it. We use this license only to operate, provide, and protect Elsewhere, and our service providers may use it only to help us do that. The license ends when your content is deleted, except for copies we keep as described in Section 11 and the Privacy Policy.

What you promise. You have the rights to your content, and it follows these Terms and the law. Don't post photos of other adults without their permission, or photos of children on their own.

Other people's content. Other users' content belongs to them. We don't endorse it and aren't responsible for it. Don't share another user's content outside Elsewhere without their permission, except to report abuse or get help.

7. Community rules

Be honest, be respectful, and keep people safe. You must not:

• Scam or ask for money. Don't ask for or offer money, gifts, gift cards, crypto, loans, investments, or payment for travel or visas. Don't ask for anyone's financial or account details.
• Deceive. Don't impersonate anyone, use someone else's photos, or run fake or duplicate accounts. Don't lie about your age, country, relationship status, or intentions.
• Harass or threaten. No bullying, stalking, threats, or intimidation. Stop contacting anyone who says no or blocks you.
• Share sexual content. No nudity or sexually explicit images, and no sexual messages the other person hasn't welcomed. Never share, or threaten to share, intimate images of anyone.
• Involve minors. Nothing that sexualizes, exploits, or endangers anyone under 18. We report child sexual exploitation to the National Center for Missing & Exploited Children (NCMEC) and law enforcement.
• Sell sex or services. No prostitution, escort services, paid companionship, or human trafficking. No advertising, selling, or recruiting of any kind.
• Promote hate or violence. No attacks on people based on race, ethnicity, nationality, religion, caste, sex, gender identity, sexual orientation, disability, or serious illness. Nothing that promotes violence, terrorism, or self-harm.
• Break the law. Nothing illegal, including selling drugs or weapons.
• Invade privacy. Don't share anyone's personal information, such as their phone number, address, or messages, without permission.
• Misuse Elsewhere. No bots, scraping, spam, or automated messages. Don't hack, reverse-engineer, overload, or interfere with Elsewhere, or use it to build a competing service or train AI models.
• Evade enforcement. Don't come back with a new account, device, email, or phone number after we ban you.

Elsewhere has no tolerance for objectionable content or abusive users. We remove content that breaks these rules, and we may suspend or ban the accounts behind it.

We may publish more detailed Community Guidelines. They are part of these Terms.

8. Your safety

ELSEWHERE DOES NOT RUN CRIMINAL BACKGROUND CHECKS OR SEX-OFFENDER REGISTRY CHECKS ON ITS USERS. We cannot confirm anyone's identity, age, or intentions, even if their profile is verified. You're responsible for your own safety when you talk to or meet anyone.

• Never send money, gift cards, crypto, or financial details to someone you met on Elsewhere, whatever the reason.
• Be cautious if someone quickly asks to move to another app. Scammers often do this.
• If you meet in person, meet somewhere public, tell a friend your plans, and arrange your own transportation.
• Before traveling abroad to meet someone, check local laws and customs, keep your passport and return ticket, and share your plans with someone you trust. Laws about relationships and sexuality differ between countries.
• If something feels wrong, stop talking, block, and report. If you're in danger, contact local emergency services. Elsewhere is not an emergency service.

Fraud alerts. If we ban an account for fraud, we may notify people who messaged with it. The alert may include that account's profile name, when you last exchanged messages, and tips to avoid fraud.

9. How we moderate

We use automated tools and human review to enforce these Terms. Automated tools never permanently ban anyone; only a person on our team can do that.

Automated tools. We use AI and other automated systems to check profiles, photos, and messages for scams, harassment, sexual content, and other rule breaks. They can flag content for our team, or limit the visibility of content or accounts.

Human review. Our team reviews user reports and flagged content, and makes every decision to suspend or ban an account.

What we may do. If we believe you broke these Terms or the law, or that your account puts others at risk, we may:

• remove or hide content;
• limit your account's visibility, so fewer people or no one sees your profile;
• restrict features, such as messaging;
• suspend or permanently ban your account; and
• block the devices, email addresses, and phone numbers linked to a banned account.

Notices. If you're in the European Union, we'll tell you when we restrict your content or account. We'll explain why, say whether automated tools were used, and tell you how to challenge the decision. We'll do the same anywhere else the law requires it. We may skip a notice for large-scale spam, or if the law or law enforcement prevents us from giving one. In other cases, we may limit visibility without notice, for example to stop scams.

Appeals. If you disagree with a decision, email hello@elsewheredating.com with the subject “Appeal” within six months. A person will review it and reply. You may also go to court where the law allows.

Reporting. Anyone can report content or accounts, in the app or by emailing hello@elsewheredating.com, even without an account. Include the profile name, what the content is, and why you think it breaks our rules or the law. We'll confirm we received it, review it, and tell you what we decided. We may ignore reports that are clearly unfounded.

Law enforcement. We may share information with law enforcement when the law requires it, or when we believe in good faith it's needed to prevent harm. We report apparent child sexual exploitation to NCMEC.

We don't have to monitor Elsewhere, and we don't review everything.

10. Purchases and subscriptions

Elsewhere is free to join. Some features cost money, through subscriptions or one-time purchases. All payments go through the Apple App Store or Google Play, and their payment terms also apply.

Subscriptions renew automatically. Before you buy, you'll see the price and how often it renews. Your subscription renews at the end of each period, and Apple or Google charges you, unless you cancel before it renews. Apple requires cancelling at least 24 hours before the period ends.

How to cancel. Cancel in your Apple or Google account's subscription settings. Deleting the app or your Elsewhere account does not cancel a subscription. After you cancel, you keep access until the end of the period you paid for.

Free trials and offers. When a free trial or discount ends, you'll be charged the regular price unless you cancel before it ends.

Price changes. We may change prices. Apple or Google will tell you before a higher price applies to your subscription, and you can cancel before it takes effect.

One-time purchases. These give you a limited, non-transferable right to use a feature. They have no cash value, can't be exchanged, and may expire as described when you buy them. Unused purchases end if your account is deleted or banned, unless the law says otherwise.

Refunds. Apple or Google handle refunds under their policies. Except as described below or required by law, payments are non-refundable, including for unused time.

Right to cancel in some US states. If you live in Arizona, California, Connecticut, Illinois, Iowa, Minnesota, New York, North Carolina, Ohio, Rhode Island, or Wisconsin, you may cancel a subscription, without penalty or obligation, before midnight of the third business day after you subscribed. To cancel, email hello@elsewheredating.com or mail us at the address in Section 16, and we'll help you get your refund through Apple or Google. If you die before your subscription ends, your estate is entitled to a refund for the time after your death. If you become disabled and can't use Elsewhere before your subscription ends, you're entitled to a refund for the time after your disability, if you tell us the same way.

EU, EEA, and Swiss users. You have a 14-day right to withdraw from purchases under EU consumer law, which you exercise through Apple or Google. If you asked for a feature to start right away, you may lose this right once a one-time purchase is delivered, or pay for the part of a subscription already provided.

Brazil. Under Brazil's Consumer Defense Code, you can cancel a purchase within 7 days of making it and get your money back. Ask Apple or Google for the refund, or email hello@elsewheredating.com and we'll help.

11. Ending your account

You can delete your account at any time in the app's settings. Your profile and conversations are deleted immediately, including for the people you were talking to. We may keep some information, such as reported content and records of banned accounts, as the Privacy Policy explains. Deleting your account doesn't cancel a subscription.

We can suspend or end your account if you break these Terms, if the law requires it, or if we reasonably believe your account puts other people or us at risk. We may also stop offering Elsewhere in some or all countries, and we'll try to give you notice first. If we ban you for breaking these Terms, you won't get a refund unless the law requires one. If we end your account or close Elsewhere when you haven't broken these Terms, we'll refund any unused prepaid amount where the law requires it.

What continues. Terms that by their nature should last after your account ends still apply, including Sections 6 (for content we keep), 10 (for amounts owed), 12, 14, 15, and 16.

12. Our intellectual property and copyright complaints

Elsewhere, including its name, logo, design, and software, belongs to SnowPea and our licensors. We give you a personal, limited, non-exclusive, non-transferable, revocable license to use the app as these Terms allow. Don't copy, modify, sell, or build on Elsewhere, or use our name or logo, without our written permission.

Feedback. If you send us ideas or suggestions, we may use them without paying you or owing you anything.

Copyright complaints. If you believe something on Elsewhere infringes your copyright, send our copyright agent a notice that includes:

1. your physical or electronic signature;
2. the copyrighted work you believe was infringed;
3. the content you believe infringes it, with enough detail for us to find it, such as the profile name;
4. your name, address, phone number, and email;
5. a statement that you believe in good faith the use isn't authorized by the owner, its agent, or the law; and
6. a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner.

If your content was removed and you believe it was a mistake, you may send a counter-notice as the law allows. We end the accounts of repeat infringers where appropriate.

13. App stores and other services

Elsewhere uses services from other companies, such as Apple, Google, and our service providers. Their own terms govern their services, and we're not responsible for them.

If you got Elsewhere from the Apple App Store, you and we agree that:

• These Terms are between you and SnowPea only, not Apple. SnowPea, not Apple, is responsible for the app and its content.
• Your license to use the app is limited to Apple-branded products you own or control, as the App Store's Usage Rules allow.
• Apple has no obligation to provide maintenance or support for the app.
• If the app fails to meet any applicable warranty, you may notify Apple, and Apple will refund the app's purchase price, if any. To the fullest extent the law allows, Apple has no other warranty obligation for the app. Any other claims, losses, or costs from such a failure are SnowPea's responsibility, not Apple's.
• SnowPea, not Apple, is responsible for any claims by you or others relating to the app, including product liability claims, claims that it fails to meet legal or regulatory requirements, and claims under consumer protection, privacy, or similar laws.
• If anyone claims the app or your use of it infringes their intellectual property, SnowPea, not Apple, is responsible for investigating, defending, settling, and discharging the claim.
• You confirm that you're not in a country under a US government embargo or designated as “terrorist supporting,” and you're not on any US government list of prohibited or restricted parties.
• You must follow any third-party terms that apply when you use the app, such as your mobile carrier's.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
• Send questions, complaints, or claims about the app to us, using the details in Section 16.

If you got Elsewhere from Google Play, Google Play's terms also apply to your download and purchases. Google is not a party to these Terms.

14. Disclaimers, limits on liability, and indemnity

Nothing in this section limits rights you have by law that can't be waived by contract.

Disclaimers. Elsewhere is provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We don't promise that Elsewhere will be uninterrupted, secure, or error-free, that translations will be accurate, or that you'll find a match. We're not responsible for how any user behaves, on or off Elsewhere, or for any content they post or send.

Limits on liability. To the fullest extent the law allows, SnowPea and its members, managers, employees, and service providers won't be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, or goodwill, arising from or related to Elsewhere, including the conduct of other users. Our total liability for all claims related to Elsewhere is limited to the greater of the amount you paid for Elsewhere in the 12 months before the claim arose, or US $100. These limits apply whatever the legal theory, even if we were told the damage was possible.

These Terms don't limit liability for death or personal injury caused by our negligence, for fraud, or for anything else the law doesn't allow us to limit. Some places don't allow some of these disclaimers or limits, so they may not apply to you.

EU, EEA, and Swiss users. The disclaimers and limits above apply to you only to the extent your country's law allows. We're liable to you as the law where you live provides.

Indemnity. To the extent the law allows, you agree to defend and indemnify SnowPea against claims, losses, and costs, including reasonable legal fees, arising from your content, your breach of these Terms, or how you treat other users.

15. Disputes, arbitration, and governing law

Talk to us first. Before starting a claim, send a written notice to hello@elsewheredating.com with your name, the email or phone number on your account, a description of the dispute, and what you want. We'll do the same if we have a dispute with you. We'll both try in good faith to resolve it within 60 days, including by phone or video call if either of us asks. Deadlines for bringing claims pause during those 60 days.

If you live in the United States, disputes go to individual arbitration. You and SnowPea agree to resolve any dispute, claim, or controversy arising from or relating to these Terms or Elsewhere (a “Dispute”) by binding individual arbitration, not in court. This includes Disputes about privacy, biometric information, and consumer protection. The Federal Arbitration Act governs this section.

• Exceptions. Either of us may bring an individual claim in small claims court if it qualifies. Either of us may ask a court to stop misuse of intellectual property. If you bring a claim of sexual harassment or sexual assault, you may choose to take it to court instead, as federal law allows.
• Rules and location. The American Arbitration Association (AAA) will administer the arbitration under its Consumer Arbitration Rules, available at adr.org. You can choose to have it by video, by phone, in writing, or in the county where you live. The arbitrator decides questions about the scope and enforceability of this section, except as stated below.
• Fees. The AAA's rules decide who pays fees, and they limit what consumers pay.
• Relief. The arbitrator can award the same individual relief a court could, but only for you, not for anyone else.
• No class actions or jury trials. You and SnowPea may bring claims only as individuals, not as a plaintiff or class member in any class, collective, consolidated, or representative proceeding. You and SnowPea waive any right to a jury trial.
• Mass filings. If 25 or more similar demands are filed by the same or coordinated lawyers, the AAA's Mass Arbitration Supplementary Rules apply, and the demands may be handled in batches as those rules allow.
• If part of this section fails. A court, not an arbitrator, decides disputes about the class action waiver or the mass filing rules. If the class action waiver can't be enforced for a claim, that claim will be decided in court, not in arbitration.
• Opt out. You can opt out of arbitration within 30 days after you first accept these Terms. Email hello@elsewheredating.com with the subject “Arbitration opt-out,” your name, and the email or phone number on your account. Opting out doesn't affect the rest of these Terms.
• Changes to this section. If we change it, you can reject the change by emailing us within 30 days after it takes effect, and the earlier version will keep applying to you.

Governing law. Indiana law and applicable US federal law govern these Terms, without regard to conflict-of-law rules.

Courts. If you live in the United States, any Dispute that isn't arbitrated will be decided only by the state courts of Tippecanoe County, Indiana, or the US District Court for the Northern District of Indiana. You and SnowPea consent to their jurisdiction.

If you live outside the United States, the arbitration section doesn't apply to you. If you live in the EU, EEA, or Switzerland, you keep the protection of your country's mandatory consumer laws, and you may bring a claim in the courts where you live. Anywhere else, you keep any mandatory protections your local law gives you, and claims go to the courts of Tippecanoe County, Indiana, unless your local law lets you bring them where you live.

16. Changes, general terms, and contact

Changes to these Terms. We may update these Terms. For material changes, we'll notify you in the app or by email at least 30 days before they take effect, unless a change is required by law or needed to address a new safety risk. If you keep using Elsewhere after a change takes effect, you accept it. If you don't agree, you can delete your account before then.

General terms.

• Whole agreement. These Terms, the Privacy Policy, and any rules we show you in the app are the whole agreement between you and us about Elsewhere.
• Severability. If part of these Terms can't be enforced, the rest stays in effect, except as Section 15 says.
• No waiver. If we don't enforce part of these Terms, we can still enforce it later.
• Transfer. You can't transfer your rights under these Terms. We may transfer ours, for example in a merger or sale of our business.
• Events beyond our control. We're not responsible for delays or failures caused by events outside our reasonable control.
• Electronic notices. You agree to receive notices from us in the app, by email, or by text message. They count as “in writing.”
• Language. These Terms are written in English. If we provide a translation and it conflicts with the English version, the English version controls, unless local law requires otherwise.
• Third parties. No one else has rights under these Terms, except Apple as Section 13 says.
